The main objective of this study was to analyze how the right to defense is violated in sanctioning administrative procedures for urban authorizations in the District Municipality of Aucallama, 2021. It was developed under the methodological guidelines of a research with a basic purpose, qualitative approach, phenomenological design and case study, scope or descriptive level and legal dogmatic type, observation and documentary analysis were used as techniques, the instruments were the structured observation guide and the documentary analysis sheet, the population was made up of officials and disciplinary procedures, to extract the sample, non-probabilistic convenience sampling was used, being made up of 10 officials and 10 files. The main results showed that the collaborators of the municipal entity sanction indiscriminately those managed that have rural land in the process of construction, pretending to demand the requirements of urban land to obtain enabling licenses. Likewise, it was evidenced that in the development of the procedure, the rights of the administrator are violated, such as due process and the right of defense, in the same line, abuse of authority is committed by similarly applying what is expressed in the norm.
