This research project refers to the crime of speculation and the difficulties in applying its penalties due to the Economic Model Recognized in the Peruvian Constitution, 2020-2022, the problem of which raises the question of what are the reasons why it is not effective. the application of penalties for the commission of the crime of speculation during the year 2020 until July 2022. The objective is to determine the causes why the application of penalties for the commission of the crime of speculation during the year is not effective. year 2020 until July 2022. An application-type methodology was used for this research since its objective is to establish what knowledge can be applied to the solution of related problems. In this sense, descriptive research is used, since it seeks to determine the reasons why sanctions are not applied to the crime of speculation; The methods proposed are the dogmatic method and the method of Legal Argumentation, the design of the applied research was qualitative in nature and the level of research was classified as explanatory, and it concludes that at present the sanction for the crime of speculation is inapplicable. that there is no institutional model that allows the application of the criminal norm, in addition none of the bills on the way solve the problem of the criminal type, and determines that the economic model recognizes that prices are formed in the market in accordance with the Law of supply and demand; Furthermore, Law 31040 has not been the subject of due evaluation and reflection during the legislative process in the Peruvian jurisdiction.
