The present investigation carries out a consistent work in the study and analysis of Article 45 ° number 1 of the State Contracting Law, in the processes submitted to Ad hoc and Institutional arbitration. Likewise, by means of the study of Arbitral, the criterion by the arbitrators regarding the application of the Institutional arbitration on the ad hoc arbitration will be examined. On the other hand, interviews will be held with expert lawyers in arbitration, officials of the chamber of commerce, the regional government and the Trujillo and Lima arbitration centers, taking into account the principles of Contractual Freedom and the Principle of autonomy of will of the parties. ; These interviews will be confronted, which will be able to arrive at a better understanding of the fact raised in the research problem and to elucidate if the described hypothesis reflects the information obtained. Therefore, Article 45, numeral 1 of the Law on State Procurement, Law No. 30225, must be modified; taking into account the doctrinal, national and foreign normative criteria, in order will be determined if the Principle of Autonomy of the Parties is limited and restricted.
