In recent years an increase in the production and demand of maca has been identified, this due to its various internationally recognized nutritional components, this is evident in the boom that presents its export level. However, several cases of biopiracy and patent applications have been identified in relation to this product. The writing of this research describes the phenomenon of biopiracy that occurred in recent years, a recurrent activity in countries with great biological diversity and little knowledge and application of intellectual property in genetic resources and traditional knowledge. Therefore, this research seeks to describe the incidence of the biopiracy of Lepidium meyenii “maca“ at the export level supported by the decrease in the exportable amount since 2016, the complaints presented by the exporters' association and the National Commission against Biopiracy. On the other hand, the methodological validity used was developed based on the research topic and the presentation of the results obtained, through the application of the collection techniques such as the documentary analysis of the current legislation on biopiracy in Peru and the interviews not Structures applied to the representatives of the institutions that make up the National Commission against Biopiracy. The results obtained allow us to analyze the Peruvian regulations on the regulation of access to genetic resources and traditional knowledge, the identification of cases of biopiracy and the analysis of the export level of “maca“ in Peru. Also, through the information presented here, the necessary bases have been developed so that future researchers interested in the subject can initiate an analysis on the research topic.
