This thesis studies the incidence of the creation of an alternative mechanism to the judicial process, in order to gain access in a more efficient and economic way to the recognition of the condition of heir and the subsequent enjoyment of the estate. Through the basic methodology used in the research and through the methods of data collection, interviews and observation, they allowed to demonstrate the proposed hypothesis. Chapter I presents the problematic reality, formulation of the problem, objectives, hypotheses, justification and conceptual definitions relevant to the proposed study, followed by Chapter II that contains the population and sample, techniques and instruments for data collection and analysis, methodological procedure and ethical aspects. For its part, chapter III contains the results obtained from the application of analytical instruments in legislative matters, interviews with experts and analysis of sentences and resolutions. Finally, the discussions and conclusions were presented in chapter IV, which demonstrate the positive impact of the creation of an alternative mechanism to the judicial process, such as the notarial procedure in cases of inheritance petition so that the predecessor can concur with the Heirs declared in the absence of opposition, litigation or controversy.
