This thesis is carried out in order to determine how the prohibition of sentence reduction for sincere confession in the crime of femicide affects the principle of procedural equality. Next, everything related to the legal figure of Sincere Confession, the crime of femicide and Legislative Decree No. 1382 was developed, which incorporates into article 161 of the criminal procedure code the prohibition of sentence reduction for sincere confession in the crime. of femicide, producing a special impact on the constitutional principle of procedural equality that must be guaranteed in all criminal proceedings. Through the study of the objectives, analysis of the jurisprudence issued by the Supreme Court, collected as a sample, the preparation of interviews with lawyers specialized in the branch of General Criminal Law - special and Criminal Procedure, as well as the investigation of undergraduate thesis , it has been possible to conclude that the current regulation of article 161 of the Criminal Procedure Code affects violating the constitutional principle of procedural equality, since a defendant who is prosecuted for the crime of femicide is discriminated against, to have a reward benefit of reduction of penalty for sincere confession, when in other crimes of equal or greater seriousness if this procedural bonus is allowed. Due to the above, the repeal of the second paragraph of article 161 of the criminal procedure code is proposed, to the extent of not applying the benefit of the sincere confession of sentence reduction in the crime of femicide; for violating the right to procedural equality.
