Abstract: La presente investigación tuvo como principal objetivo determinar de qué manera se aplica el principio del debido procedimiento, en el régimen disciplinario de la Policía Nacional del Perú, regulado bajo la Ley Nro. 30714 en sus dos modalidades o partes componentes: el cumplimiento del principio de legalidad y el principio de razonabilidad. Es preciso indicar que la presente investigación se desarrolló en el marco del enfoque cualitativo, de tipo básica descriptiva y con diseño de la Teoría Fundamentada; la técnica utilizada fue el análisis documental, principalmente de la ley N° 27444 concordada con la Ley N° 30714. Se identificó como principal hallazgo que las leyes arriba citadas con concuerdan en aspectos relativos a los plazos lo que permitió concluir que en el régimen disciplinario de la Policía Nacional del Perú vulnera se el debido procedimiento en tanto se afecta gravemente el principio de legalidad dispuesto en a ley N° 27444 y también se vulnera el principio de razonabilidad al imponer sanciones excesivas al personal policial.
The main objective of this investigation was to determine how the principle of due procedure is applied, in the disciplinary regime of the National Police of Peru, regulated under Law No. 30714 in its two modalities or component parts: compliance with the principle of legality and the principle of reasonableness. It is necessary to indicate that the present investigation was developed within the framework of the qualitative approach, of a basic descriptive type and with Grounded Theory design; The technique used was the documentary analysis, mainly of Law N ° 27444 agreed with Law N ° 30714. It was identified as the main finding that the above-cited laws agree on aspects related to the terms, which allowed to conclude that in the disciplinary regime of the National Police of Peru violates due procedure insofar as the principle of legality provided in Law No. 27444 is seriously affected and the principle of reasonableness is also violated by imposing excessive sanctions on police personnel.
