The objective of this Professional Sufficiency Work is to carry out a legal analysis of Resolution No 001-2024-SUNAFIL/TFL, in which it is discussed whether a sanction imposed after the immediate rectification of non-complience, after intervention by union, qualifies as a measure that can be considered reasonable or if, on the contrary, it qualifies as excessive punishment. This work is developed in three aspects: Firstly, the procedure that led to issuance of the resolution subject to analysis is presented. Secondly, the concepts and standards applied in the matter are reviewed. Thirdly, the examination carried out by Labor Supervision Court on the reasonableness of the sanctioning measure applied and the foundations that led to its classification as a precedent of mandatory observance is considered. The appreciation of the duo is also added to the scope of the resolution. The importance of this work lies in evidencing the need for a reasonable application regarding punishment, which ensures the effectiveness of the measure and the proportionality between the content of the sanctioning act and its purpose, which in the specific case is to protect the dignity of the people facing a hostile act by the employer.
