This study arises from the analysis of Cassation N° 3500-2017 Lima. It focuses on the request for a judicial declaration of de facto union, which has been filed by the defendant against an intestate succession. The Supreme Collegiate Court declared the cassation appeal unfounded, arguing the absence of material normative infringement of articles 326 of the Civil Code, 4 of the Political Constitution of Peru, and Law N° 30007, as well as the procedural normative of article 139 subparagraphs 3 and article 5 of the Constitution; with a singular vote from Supreme Judge Romero Díaz and a minority vote from judges Caballero and Calderón. In the examined legal context, there is a notable issue highlighted by the singular vote, supported by the majority and deferred by the minority vote of the Supreme Court. This issue concerns the interpretation of the impediment requirement to marry in relation to the configuration of the de facto union, as well as the determination of the appropriate timeframe to request this declaration. In the present work, we shall examine the support for the positions of majority vote and singular vote. Given the existence of a matrimonial bond and the alteration of the legal status from cohabitants to spouses, the calculation of the two-year period, essential for the proper establishment of a de facto union, is interrupted and thereby concluded. Consequently, the recognition of a de facto union under such circumstances is deemed procedurally improper.
