The public policy aims to solve social needs, so the State must incorporate new strategies and decision-making processes. The National Penitentiary Policy promoted less overcrowding in penitentiary establishments along two lines: penitentiary infrastructure, and regulatory measures that speed up and optimize the investigation processes. The construction of penitentiary establishments aims to close gaps in the social reintegration service, which by the end of 2022 reaches 69%; That is to say that, 21 of the 68 penitentiary establishments at the national level have an unsuitable and installed capacity. A view at the portfolio of prison infrastructure projects evidenced the existence of projects that have not registered progress in their physical and financial execution. The causes are of a budgetary nature, operational capacity, investment management; but it was also evidenced the existence of causes in phase I of the investment cycle, that corresponds to the Multiannual Investment Programming, directly related to their planning and programming. The planning process in investment management is an instrument for analysis and planning of the route to follow in the project cycle. From this, decisions are made at a prospective level, setting objectives, and physical financial goals, incorporating criteria of efficiency and effectiveness. Identifying the causes of inadequate investment planning will lead to a reconsideration of actions in the management of investments in prison infrastructure or, if necessary, a reconsideration of public policy to deal with prison overcrowding in a better, realistic, objective, and possible timeless horizon.
