Abstract: El presente trabajo de investigación tuvo como finalidad determinar de qué manera
se vulnera el derecho a la dignidad en el sistema penitenciario de Trujillo, en cuyo
caso se aplicó un enfoque cualitativo, diseño no experimental y de nivel descriptivo;
asimismo el instrumento se sustentó en la aplicación de una estrevista semi
estructurada en base al análisis de 10 de especialistas en Derecho Constitucional
y Penal, así como la revisión documental de jurisprudencia pertenecientes a los
países de Colombia, Chile y Perú. Los resultados demostraron que el sistema
penitenciario de Trujillo revela un fracaso estatal frente al hacinamiento, por lo que
se advierte cómo este fenómeno afecta no solo el cumplimiento de las metas
resocializadoras y preventivas de las penas, sino también cómo constituye una
violación flagrante de los derechos constitucionales y fundamentales de las
personas privadas de libertad. Desde esta óptica, el hacinamiento no solo es un
síntoma de deficiencias administrativas o de gestión, sino que refleja un fallo
profundo en el cumplimiento de los principios básicos del Estado de derecho y de
los derechos humanos reconocidos tanto en la Constitución Política del Perú como
en la Conveción Americana sobre Derechos Humanos y Reglas Mínimas de las
Naciones Unidas para el Tratamiento de Reclusos. Por otro lado, el Estado sostiene
la obligación de garantizar que las penas privativas de libertad se ejecuten de
manera que respeten la dignidad humana y busquen la rehabilitación del
condenado; sin embargo, el escenario descrito evidencia un desmerecimiento por
estas obligaciones, con el hacinamiento exacerbando condiciones que bordean o
constituyen tratos crueles, inhumanos y degradantes, contrarios al derecho a la
integridad personal
The purpose of this research work was to determine how the right to dignity is violated in the Trujillo prison system, in which case a qualitative approach, non- experimental design and descriptive level was applied; Likewise, the instrument was based on the application of a semi-structured interview based on the analysis of 10 specialists in Constitutional and Criminal Law, as well as the documentary review of jurisprudence belonging to the countries of Colombia, Chile and Peru. The results showed that the Trujillo penitentiary system reveals a state failure in the face of overcrowding, which shows how this phenomenon affects not only the fulfillment of the resocializing and preventive goals of sentences, but also how it constitutes a flagrant violation of rights. constitutional and fundamental rights of persons deprived of liberty. From this perspective, overcrowding is not only a symptom of administrative or management deficiencies, but also reflects a profound failure in compliance with the basic principles of the rule of law and human rights recognized both in the Political Constitution of Peru and in the American Convention on Human Rights and the United Nations Standard Minimum Rules for the Treatment of Prisoners. On the other hand, the State maintains the obligation to guarantee that custodial sentences are executed in a manner that respects human dignity and seeks the rehabilitation of the convicted person; However, the scenario described shows a disregard for these obligations, with overcrowding exacerbating conditions that border on or constitute cruel, inhuman and degrading treatment, contrary to the right to personal integrity
