The current investigation has as legal support, the additional investigative acts, ordered by the superior prosecutor, which is materialized in the criminal procedural legal institution of the supplementary investigation, in that sense, the entire procedure that regulates the aforementioned is prescribed. in the normative body of legislative decree No. 957, in addition, the research work has been addressed by national doctrine and jurisprudence, but not, in its different problems, for example, the violation of the guiding principles of the accusatory system as a consequence of the additional acts of investigation ordered by the senior prosecutor. Considering what has been said up to this point, the investigation was carried out to determine; ““How the additional acts of investigation ordered by the superior prosecutor violate the fundamental bases of the accusatory system in the Peruvian criminal process.““ Likewise, to determine what was stated above, an essentially dogmatic and practical investigation was carried out, using the methods noted in this work, in addition, comparative law was used, in order to have a broad vision of the subject matter of research, with the mission of comparing, if in the legislations of other countries, the additional acts of investigation ordered by the superior prosecutor violate guiding legal principles, specific to each legal system. Therefore, after carrying out a thorough analysis, it was concluded that the additional acts of investigation ordered by the superior prosecutor violate the fundamental bases of the accusatory system in the Peruvian criminal process, because it is a fiscal power not regulated in. The law, furthermore, constitutes fiscal interference in a strictly jurisdictional function.
