Abstract: La presente investigación tiene como título “Fraude inmobiliario en los contratos de
compraventa, Lima Metropolitana, 2020”. Esta investigación pretende analizar y determinar en
qué forma los fraudes inmobiliarios afecta los contratos de compraventa. La población elegida
se determinó por ciudadanos en Lima Metropolitana quienes tienen una opinión respecto a los
contratos de compra venta de bienes inmuebles, y la muestra lo conforman 30 abogados que
responderán un cuestionario como instrumento de medición. El método de investigación
desarrollado fue no experimental de corte transversal, con enfoque cuantitativo. Respecto a los
hallazgos, se evidenciaron una correlación significativamente proporcional entre las variables
estudiadas, concluyendo en afirmar que existe un aumento de fraudes en los contratos de
compra venta de bienes inmuebles. Esta investigación pretende determinar el conocimiento de
un estudio que evite estas actividades que dañan las transacciones económicas de las personas
que buscan generar activos. Por último, se pretende sentar las bases para una futura
modificación normativa que pueda dar seguridad jurídica, no solo en el acto de compraventa,
sino en todas las transacciones comerciales de bienes inmuebles en el Perú.
This research is entitled “Real estate fraud in sales contracts, Metropolitan Lima, 2020“. This research aims to analyze and determine how real estate fraud affects sales contracts. The chosen population was determined by citizens in Metropolitan Lima who have an opinion regarding the contracts for the sale of real estate, and the sample is made up of 30 lawyers who answer a questionnaire as a measurement instrument. The research method developed was nonexperimental, cross-sectional, with a quantitative approach. Regarding the findings, a significant proportional correlation was evidenced between the variables studied, concluding in stating that there is an increase in fraud in real estate purchase and sale contracts. This research aims to determine the knowledge of a study that avoids these activities that damage the economic transactions of people who seek to generate assets. Finally, it is intended to lay the foundations for a future regulatory modification that can provide legal certainty, not only in the act of sale, but in all commercial transactions of real estate in Peru.
