The present investigation on the crime of generic falsification in the form of vehicle identity theft - “cloning“ and its impact on the Right to Property and Legal Security. Its objective is to establish to what extent the crime of generic falsehood in the form of vehicle identity theft - “cloning“ affects the Right to Property and Legal Security. Likewise, the research has a basic quantitative approach, a non-experimental cross-sectional or transectional design and a correlational level. The techniques of the interview and documentary analysis were applied, applied to the justice operators of the Superior Court of Justice of North Lima and the judicial files corresponding to the cases for crimes of generic falsehood in the modality of vehicle identity theft “cloning”. At present, there are new variants of vehicle identity theft in its “cloning” mode, such is the case in which a criminal gang acquires damaged luxury cars for really low amounts. Simultaneously they steal other vehicles with similar characteristics. Then they put the plate from the first to the second to sell it at high prices in the automotive market. Likewise, criminal organizations have another way of operating. Once they acquire the wrecked cars, they repair them and insure them in an insurance company other than the original car. Then they report false claims to collect the insurance policy. Against this background, we present the problem that this criminal practice represents, against the Public Faith and in turn, to what extent this crime affects fundamental rights such as the Right to Property and guarantee principles in our legal system, as is the case of the Principle of Legal Security.
