Abstract: La presente Tesis para optar el título de Magister en Derecho con mención en Ciencias Penales, del Bachiller PEDRO ABRAHAM VALDIVIA DEXTRE, titulada “Los delitos contra los derechos de autor en el Perú”,corresponde a una investigación teórico-dogmático, en la que se efectúa el correspondiente análisis de las normas penales correspondientes a los ilícitos estudiados, además del análisis documental de sentencia emblemáticas, nacionales y extranjeras, sin menoscabo de ello y a la luz de los desarrollos de las teorías metodológicas, se proyecta también con aspectos de la investigación cuantitativa, es sus vertientes causal y correlacional, en definitiva se trata de una tesis con metodología ecléctica (cualitativa – teórico dogmático-, y cuantitativa – causal y correlacional-), con lo cual gana en rigor teórico.
Está dividida en doce capítulos, entre los cuales cabe destacar que el autor hace un análisis jurídico integral del tema materia de tesis, vale decir, analiza aspectos Doctrinales de la Propiedad Intelectual, y sus especies: Propiedad Industrial, y Derechos de Autor; asimismo Aspectos Históricos, Constitucionales, Derecho Internacional, Derecho Penal, y Procesal Penal (Jurisprudencia).
The present Thesis for the Master's Degree in Law with mention in Criminal Sciences, of the graduate PEDRO ABRAHAM VALDIVIA DEXTRE, entitled “Crimes against copyright in Peru“, corresponds to a dogmatic- theoretical investigation, in which performed the corresponding analysis of criminal law for the crimes studied, besides the documentary analysis of judgment emblematic, in addition to judgment emblematic documentary analysis, domestic and foreign, without damage of it and in the light of the developments of the methodological theories, it is projected also by aspects of the quantitative investigation, in its causal and correlational aspects. Definitively, it is a question of a thesis with Eclectic Methodology (qualitative - dogmatic theoretical, and quantitative - causal and correlational-), which gains in theoretical rigor. It is divided into twelve chapters, including noteworthy that the author makes a comprehensive legal analysis of the subject matter of the thesis, in other words, analyzes Doctrinal aspects of Intellectual Property, and its species: Industrial Property and Copyright; likewise Historical, Constitutional aspects, International Law, Criminal Law, and Criminal Procedure Law (Jurisprudence).
