Abstract: En este presente trabajo de investigación se expondrá un breve resumen referido a un
proceso sumarísimo de desalojo por ocupante precario, el cual se analizará la Controversia
procesal del Expediente Nº 02823-2010, alusivo al tema de las clausulas resolutorias de un
Contrato de Compra Venta de un bien inmueble, que deben agotarse en la etapa pre- judicial y
posteriormente haciendo valer el derecho del propietario en la etapa judicial. Cabe resaltar que
son Contratos con prestaciones reciprocas, el cuál una de las partes (demandante o demandado)
falte a su cumplimiento; este podría resolverse bajo los alcances de las normas del Código Civil.
En este proceso se analiza específicamente la Resolución de contrato por incumplimiento y la
Resolución de pleno derecho para dejar sin efecto un Contrato y poner fin a esté, haciendo un
correcto estudio para su utilización.
In this present research work, a brief summary will be presented referring to a summary process of eviction by precarious occupant, which will analyze the procedural controversy of File No. 02823-2010, alluding to the issue of the clauses resolving a Purchase Contract Sale of an immovable property, which must be exhausted in the pre-judicial stage and subsequently enforcing the right of the owner in the judicial stage. It should be noted that they are contracts with reciprocal benefits, which one of the parties (plaintiff or defendant) fails to comply with; This could be resolved under the scope of the Civil Code regulations. This process specifically analyzes the Contract Resolution for breach and the full Resolution to terminate a Contract and terminate it, making a proper study for its use.
