The Security and Health in the Work in the world area, they are considered to be props in the development of a country. His actions are directed the promotion and protection of the health of the workers and the prevention of work accidents and occupational diseases caused by the conditions of work and occupational risks in the diverse economic activities. The foundation of this investigation as for occupational health and specifically in prevention of work accidents and occupational diseases, takes root in the importance that has the Mining industry in Peru and how it is that one comes increasing the mining exploitation in diverse zones of the country, the economy being extended of this form not only across the foreign capitals, if not that also would be increasing the possibility of continuing appearing work accidents and occupational diseases in this important labor sector for having the labor atypical days. On having spoken about Prevention of occupational diseases and work accidents, we have to indicate that this implies having a System of Management of Security and Health in the Work, the fact that adequately implemented, it is going to give us like proved an opportune prevention opposite to the factors of risk of the work. We know that the Constitutional Court issued a judgment that was a binding precedent and therefore of obligatory fulfillment for the mining sector, which was given in the Exp. 4635-2004 AATC; but to this judgment that was indicating that it have to of being employed only 8 hours at the mining activity, there is issued later an explanatory judgment that is a matter of discussion.
