Abstract: El presente trabajo desarrollado es acerca del estudio y análisis del expediente civil N°28990 Tramitado el año 2001 en el 55° Juzgado Civil de Lima por Desalojo por Ocupante Precario, demanda interpuesta por Marcos Neptali Vargas Herrera y Mihaela Creanga de Vargas, en contra de la persona de Gladys Liendo Pacheco, a efectos de que la última de las nombradas les restituya la posesión de sus inmuebles que venía ocupando sin título alguno que sustenten dicha posesión; así como el pago de una indemnización por daño y perjuicios.
Es así que en el desarrollo del análisis tomarnos en cuenta el trámite del proceso el cual se llevó a cabo bajo las reglas de un proceso Sumarísimo en la cual en una Audiencia Única se llevaron a cabo una serie de actos procesales como el saneamiento procesal, fijación de puntos controvertidos admisión de los medios probatorios, analizaremos la sentencia en primera instancia la cual fue favorable para los demandantes la misma que fue apelada por no encontrarse conforme , pondremos énfasis en el estudio del recurso de Apelación, el cual está sustentado en una mala aplicación del artículo 911 del Código Civil, posteriormente llegamos al Recurso de Casación el cual La Sala Civil Transitorio de la Corte Suprema de Justicia de la Republica con su sentencia Casatoria N°2762-2002 crea un Precedente Vinculante que a nuestro modo de ver que en los contratos de arrendamientos no le es aplicable el Art. 911 del Código Civil.
The present work is about the study and analysis of the civil file N ° 28990 Processed the year 2001 in the 55th Civil Court of Lima for Eviction for Precarious Occupant, lawsuit filed by Marcos Neptali Vargas Herrera and Mihaela Creanga de Vargas, against the person of Gladys Liendo Pacheco, to the effect that the last of the named restitute the possession of their property that had been occupying without any title to sustain said possession; as well as the payment of compensation for damages. Thus, in the development of the analysis we take into account the processing of the process which was carried out under the rules of a summary process in which in a single hearing a series of procedural acts were carried out, such as procedural sanitation, of controversial points admission of evidence, we will analyze the judgment in the first instance which was favorable for the plaintiffs who was appealed for not being satisfied, we will emphasize the study of the appeal, which is based on a bad application of article 911 of the Civil Code, later we come to the Appeal of Cassation which the Transitory Civil Chamber of the Supreme Court of Justice of the Republic with its Casatoria sentence No. 2762-2002 creates a binding precedent that in our view that in the Lease contracts are not applicable to Art. 911 of the Civil Code.
