Expediente Civil - 83515-2002-00433-0, Divorcio por La Causal de Separación de Cuerpos Incorporado al Código Sustantivo Conforme Ley N° 27

Abstract

El presente trabajo versa sobre la aplicación de la Ley 27495, ley que incorpora la causal de separación de hecho para el posterior trámite de divorcio en el artículo 333° del Código Civil Peruano. Menciona la interpretación de los magistrados del Poder Judicial en sus diferentes niveles y la participación dirimente y definitiva de la Corte Suprema de Justicia. Trata también sobre la decisión personal de poner fin a un matrimonio irregular, para lo cual la demandante buscó tutela judicial efectiva, la cual si bien es cierto inicialmente fue negada; pero que posteriormente se le concede a la demandante por haber aportado elementos de convicción uniformes y suficientes que acreditaron su pretensión.

The present work deals with the application of Law 27495, a law that incorporates the grounds for de facto separation for the subsequent divorce proceedings in Article 333 of the Peruvian Civil Code. It mentions the interpretation of the magistrates of the Judicial Power in its different levels and the decisive and definitive participation of the Supreme Court of Justice. It also deals with the personal decision to end an irregular marriage, for which the plaintiff sought effective judicial protection, which although it is true initially was denied; but that later it is granted to the plaintiff for having contributed elements of conviction uniform and sufficient that credited their claim.
