Abstract: El presente trabajo, está orientado en realizar un resumen analítico del Expediente Civil N° 4083-2011, que tiene relación con la demanda de divorcio por causal de separación de hecho, interpuesto por don Luis Miguel Gutiérrez Sotelo, ante el Sexto Juzgado Especializado en Familia de la Corte Superior de Justicia de Lima, en contra de su cónyuge Patricia Martha Niezen Arias.
Al respecto, realizado un minucioso análisis del expediente en estudio, se constató que la demanda se tramitó en la vía de proceso de conocimiento, con fecha de inicio el 31 de marzo del año 2011, con la postulación de la demanda y concluyó el 21 de mayo del año 2014, con el fallo de la Sala Civil Transitoria de la Corte Suprema, que declaró fundado el recurso de casación interpuesto por la demandada Patricia Martha Niezen Arias, en consecuencia, al término del proceso, se declaró fundada la demanda, por lo tanto, las partes quedaron divorciados, y se le otorgó a la demandada el derecho a una pensión del 8% del total de los ingresos que percibe el demandante en su centro de labor, con la sola deducción de los descuentos de Ley, asimismo se le otorgó el pagó de la suma de S/.
10.1.1 nuevos soles, por concepto de indemnización, por ser la cónyuge más afectada; proceso que se desarrolló en forma regular conforme a los plazos establecido por el Código Procesal Civil, sin embargo, se incurrió en algunas irregularidades, errores y contradicciones entre las instancias, conforme se detalla en el presente trabajo.
The present work is aimed at making an analytical summary of the Civil File N° 4083-2011, which is related to the divorce claim by reason of separation of fact, f iled by Mr. Luis Miguel Gutiérrez Sotelo, before the Sixth Court Specialized in Family of the Superior Court of Justice of Lima, against his spouse Patricia Martha Niezen Arias. In this regard, conducted a thorough analysis of the file under study, it was found that the claim was processed in the process of knowledge process, starting on March 31, 2011, with the application of the claim and concluded on 21 May 2014, with the decision of the Transitory Civil Chamber of the Supreme Court, which found the appeal filed by the defendant Patricia Martha Niezen Arias well founded, consequently, at the end of the proceedings, the claim was declared well founded, Both parties were divorced, and the defendant was granted the right to a pension of 8% of the total income received by the plaintiff in his work center, with the sole deduction of the Law discounts, granted the payment of the sum of S/. 10.00.00 nuevos soles, for compensation, as the spouse most affected; process that was developed in a regular manner according to the deadlines established by the Civil Procedure Code, however, there were some irregularities, errors and contradictions between the instances, as detailed in this work.
