This paper analyzed the cassation decision No. 5831-2019 LAMBAYEQUE/Pleno Casatorio originated by a cassation appeal related to the challenge of extramarital paternity, analyzed from the principle of the best interest of the child. José Luis Inoñán Bances contested the extramarital paternity of Y.S.I.F. His alleged parents, Sarita del Milagro Fernández Barreto and Jorge Luis Inoñán Bances, rejected the claim. Although the DNA analysis confirmed that the plaintiff was the biological father, the first instance dismissed the claim, prioritizing dynamic identity over static identity. In the second instance, the plaintiff alleged violation of due process and the rights of the minor, but the hearing decision ratified the initial decision. He filed an appeal in cassation, which was admitted by the Supreme Court, which revoked the judgment and ordered a new ruling that protects the best interests of the child and due process. In the present investigation there is a conflict between the decisions of the first and second instance, and what was resolved in the cassation, since in the first decisions the dynamic identity prevails and in the last one the static identity, considering that it was required to value the DNA test. With the doctrine, jurisprudence and regulations analyzed, it is concluded that the triple filiation respects the biological paternity of the plaintiff and the affective relationship that the minor has with the defendant, seeking to safeguard the best interests of the minor.
