This paper focuses on the legal figure of the de facto union, presenting as main objective, the legal analysis of two pronouncements issued by the National Superintendence of Public Registries (SUNARP). In the first place, the CCXXI Plenary Registry, which admitted the admissibility of registering in the registry of natural persons the substitution of the patrimonial regime in a de facto union duly accredited by notary or judicially. Secondly, Resolution No. 993-2019-SUNARP-TR-T, which generated the registration of the first substitution of the patrimonial regime in a de facto union, the latter as a result of the plenary agreement that created a binding and mandatory precedent. Taking into account those pronouncements, the objective of this paper is to legally analyze whether SUNARP exceeds the powers granted by admitting as registration in the personal registry an act that is not expressly regulated in the Peruvian legal system, making a series of interpretations, citing the relevant rules regarding the legal framework that provides for the de facto union in Peru. Likewise, the purpose is to analyze whether the established norms impose on the legal figure of the de facto union a forced regime such as that of the community property, without the possibility that the cohabitants can freely choose the property regime who wish to acquire or replace the community of assets that they already hold through the separation of assets.
