The purpose of this research work is to carry out a legal analysis of how a discriminatory case of a member of the LGBTIQ community, after exhausting all the resources offered by Peru and the relevant norms. It resorts to supranational law, through the IACHR Court and can protect the rights that were not guaranteed by the national justice system. Therefore, after observing the administrative and judicial process of the Peruvian State apparatus, it was determined that the Peruvian State violated the plaintiff's rights. Likewise, it highlights the respect for equality before the law and non-discrimination of persons regardless of their sexuality in any area of Peruvian territory. The ruling ordered the payment of compensation to the plaintiff and a series of measures that the State must comply with, so that this type of activities do not happen again in the near future and establish a precedent in case there are similar situations. Emphasizing that the Court will supervise that its decision is fully complied with. Therefore, this ruling is a favorable step for members of the LGBTIQ community and for all persons who may suffer a violation of their fundamental rights. This by entities that hold a greater degree of power over ordinary people, who are also protected.
