The purpose of the research is to analyze the ruling of Constitutional Court (TC) 676/2020, which revolves around the amparo process filed by Oscar Ugarteche. His aim was to have his marriage legally celebrated in Mexico with his partner Fidel Aroche recognized by RENIEC (National Registry of Identification and Civil Status). While Ugarteche sought only the recognition of his union by RENIEC, the ruling opens the door to delve into the implications of a potential regulation of same-sex marriage in Peru. Consequently, the topic of the study is “Recognition of Same-Sex Marriage in Peru: The Ugarteche Case and the Provisions of the Inter-American Court of Human Rights (CorteIDH)“. Furthermore, the research will be based on pronouncements of the TC justices, particularly the analysis of their individual dissenting opinions. Additionally, the study of judgments from the CorteIDH and the European Court of Human Rights will be integral to the research, as both courts have advocated for the protection of such unions. Similarly, the Constitution, Civil Code, and statements from national and international entities will contribute to achieving the outlined objectives. Lastly, the legal matter at hand, both in the ruling and the research itself, falls within Constitutional Law, as it involves rights such as equality, non-discrimination, and the free development of personality. In conclusion, a legislative proposal will be put forth to recognize same-sex marriage within a framework of respect and non-discrimination based on sexual orientation.
