This research report develops an analysis of the crimes of endangerment related to administrative offences, within the framework of typifying the crime of environmental pollution according to the criteria of interpretation established in Plenary Agreement No. 02.B-2023/CIJ-11 of the Supreme Court of Justice. This agreement establishes the interpretation criteria for the correct typification of the crime of pollution of the environment, in accordance with the concepts of “result-based crime” and “abstract danger”. It also establishes that difference between administrative offence and criminal offence is that a criminal offense requires, apart from the infraction, that the conduct is ideal to cause danger. In this sense, we will assess the agreement’s contribution to case law given that, what the judges established therein is key in differentiating between the administrative and criminal law. Therefore, our position is to acknowledge the mixed nature of the criminal type, in accordance with the majority of national doctrine. Nonetheless, we criticize the lack of a deeper debate given the complexity of this crime, which leads us to our proposal: prepare a restrictive list of scenarios that provide the judge with a greater scope when developing his ruling and imparting justice.
