Currently, having a tattoo generates diverse opinions in society and even more so when it comes to a police officer, which is why it has become a topic of discussion that should be given importance. Given this panorama, this work investigates the use of tattoos and the right to free development of personality in the PNP around the Plenary Session No. 336/2022. In this regard, the arguments are developed that allow us to understand the vote of the four magistrates, of which three are uniform while the last maintains a singular vote. The importance of knowing the reasons for uniform votes lies in the fact that each one explains different reasons. Likewise, we agree with the decision adopted by the majority since it allows us to carry out an in-depth analysis of the use of tattoos by police personnel. In this sense, a legal analysis is carried out that brings into debate the alleged medical complications that the use of tattoos and its prohibition can cause. Likewise, it is crucial to make a modification to the internal rule that regulates the use of tattoos by members of the PNP where their use is allowed under exceptions, so its prohibition must be duly justified so as not to violate the free development of personality and right to non-discrimination at work.
