This Professional Sufficiency Work analyzed the correct application of the competency test in the framework of a competency conflict, applicable to a municipal ordinance that was questioned through a demand for unconstitutionality action filed by the Executive Branch, which was declared partially founded and issued as a majority block by the judges of the Constitutional Court. Under this context, the first chapter develops the background, relevant foundations of the judgment 437/2023 and the singular votes of the magistrates. In the second chapter, the legal concepts relevant to the present case are presented, such as the concept of decentralization, regulations applicable to the National and Local Government, the non bis in idem principle and the conflict of competence. The third chapter analyzes how the Constitutional Court should have rule on said conflict of competence, which was initially processed as an unconstitutionality action. In that sense, with the doctrine, jurisprudence and applicable regulations, it is evident that the Court omitted to rule on a metropolitan ordinance, a law and its regulations, which enable the local government to legislate regarding the management of public spaces. In conclusion, it is verified that the lack of pronouncement on the aforementioned regulations implies a serious contradiction in the legislation and limits the ability of local governments to satisfy the needs of the citizens of their area district.
