Nowadays, discrimination in the workplace continues to be a daily and universal phenomenon, especially when we put men and women on the scales. In fact, it is in this area where most of these situations occur, the most common of which are dismissals. This paper exposes the judgment of the Constitutional Court under file No. 00644-2022-PA/TC, which accounts for the constitutional grievance filed by Mrs. María Indira Alvarado, by means of which she requests that Memorandum 1432-2014-MML-GA-SPCAS be declared null and void and inapplicable, in which it is communicated that the labor relationship she had with the Metropolitan Municipality of Lima would be terminated under the decision of the non-extension of her employment contract, without expressing any cause or reason related to her conduct and/or work capacity. She supports her appeal on the grounds that her dismissal constitutes an abusive and discriminatory act, which violates her constitutional rights to work, to job stability, to defense, and the principle of inalienability of her rights. The purpose of this paper is to analyze a specific case of labor termination based on discrimination for being a nursing mother, highlighting how this practice affects the labor stability of female workers. It also seeks to identify the special role of the State with regard to the protection of the rights of working mothers through Peruvian legislation and jurisprudence.
