This work is based on the historic ruling issued by the Constitutional Court in Case No. 00853-2015-PA/TC, concerning the right to education of individuals in extreme poverty in rural areas. This case begins with the story of two sisters, Marleni and Elita Cieza Fernández, whose enrollment requests were rejected in a rural area of Amazonas due to their age. In this regard, this paper will analyze the content of the right to education and the actions taken by the State to ensure its full exercise. In this context, the Constitutional Court (TC) has issued concrete measures through the declaration of an unconstitutional situation to prevent the violation of the right to education for individuals in this situation. In this regard, through a detailed examination of jurisprudence, as well as specialized literature in human rights and constitutional law, an understanding of the limits and scope of the right to education and equality is sought. Additionally, specialized academic journals and theses on the subject have been consulted to enrich the development. It is concluded that the ruling of the Constitutional Court represents a turning point in the struggle for the right to education in the country. Through this decision, new opportunities are opened to build a more inclusive and accessible educational system for all Peruvians, regardless of their socio-economic or geographical situation.
