This report is drafted as a result of the analysis carried out on the sentence related to Case No. 02748-2021-PA/TC, which originated through a constitutional grievance appeal filed by Jenny Marvila Meléndez Vega against the Civil Chamber of the Superior Court of Justice of Madre de Dios; this, because the plaintiff requested her reinstatement to the position of “Nursing Technician“ at the Victor Lazo Peralta Hospital of the Madre de Dios Health Care Network of EsSalud due to being arbitrarily dismissed during pregnancy. It is important to note that, at the time of said dismissal, the plaintiff was working without a contract, therefore she alleged the violation of the principle of the primacy of reality, violation of constitutional rights, protection of the pregnant mother, and due process. To carry out the analysis, legal, scientific, and academic sources were consulted, which allowed us to agree with the position of the Constitutional Court that the case be resolved in favor of the plaintiff, since her reinstatement was imminent due to not only the misrepresentation of the employment relationship but also the violation of the cited constitutional rights. It should be noted that, although the Huatuco Precedent should not apply in this case, since the plaintiff did not enter the position through a public competition, the Court applied the criterion partially, as it extraordinarily protected and prioritized violated fundamental rights in order to safeguard the well-being and occupational development of pregnant mothers, who are protected against this type of dismissal.
