Currently, social networks have changed the way people interact, transitioning from being a traditional means of communication to becoming a lethal instrument that results in a transgression of citizens' fundamental rights. Within this context, this paper will analyze Constitutional Court Judgment No. 01163-2022-PHD/TC, through which the demand for inquisitive habeas data filed by Mr. Edward Antonio Muñoz Salazar against Mr. José Alfredo Infante Carmen is resolved. Likewise, the plaintiff's claim was for the defendant to provide him with the data of the person who provided his sensitive information. Additionally, the plaintiff argued the violation of his right to informational self-determination due to an incorrect interpretation of the typology of habeas data and the non-application of regulations related to personal data protection. However, this Collegiate Body determined that his right would not be violated, as the claim is not within the scope of habeas data protection. Furthermore, they pointed out that a Facebook account cannot be considered a database, as there is no evidence of personal data processing. Finally, various bibliographic sources have been consulted to demonstrate that a Facebook account is indeed a database and that the alleged claim was indeed guaranteed by habeas data.
