This project deals with the review of Resolution No. 551-2023-OEFA/TFA-SE, administrative precedent of mandatory observation issued by the Environmental Inspection Tribunal of the Environmental Assessment and Oversight Agency (OEFA), on the application of the principle of “No Reformatio in Peius” or “Prohibition of Reform for the Worse”. The research carried out has the purpose of studying the scope established with respect to the principle of No Reformatio in Peius in an administrative sanctioning procedure in environmental matters and its effects before the declaration of nullity of an administrative resolution that imposed a sanction, since this declaration extinguishes the administrative act and its effects. Therefore, for the development of our work we have resorted to the interpretation of some articles of the General Administrative Procedure Law, as well as to the administrative doctrine in reference to the concepts and legal nature of the administrative act. In this regard, from the analysis of the referred file we have concluded that there will not be an affectation to the principle of No Reformatio in Peius before the declaration of nullity of the administrative acts, since this and its effects disappear, returning the situation to the moment of the generation of the act, a matter that must be evaluated by the corresponding instances at the moment of issuing an administrative pronouncement.
