This paper analyzes the violation of human rights in the establishment of the migration policy that regulates the flow of Venezuelan citizens to Peru, in the context of Resolution No. 00688-2020-PHC/TC, which represents the development, progress and evolution of Peruvian regulations and, particularly, of migration law. In 2019, more than five million Venezuelan citizens were forced to leave their country of origin due to the political, health and economic crisis that Venezuela is going through. In this context, Peru was one of the main countries that was immersed in massively welcoming foreign citizens, as refugees. However, far from safeguarding Venezuelan migration, the migration policy established by the Peruvian State violated certain principles of international human rights law. Therefore, this paper seeks to make visible the violations that occurred in the migration policy implemented by the Peruvian State, as well as to provide alternatives for the respect of the rights of the migrant population, in accordance with domestic regulations and international treaties, to which Peru is part off.
