This paper presents and analyzes the judgment issued in Case No. 00238-2021-PA/TC. In the Constitutional Court's Decision originated by a constitutional grievance filed by against the First Civil Chamber of the Superior Court of Justice of Lima, because the plaintiff wanted the Ministry of Health (Minsa) to inform and distribute free of charge the so-called emergency oral contraceptive or emergency oral contraception in all state health centers. In order for all women to be adequately informed and have access to this product, thus avoiding unwanted pregnancies and forced pregnancies. The topic of research of the work is the controversy of the case, whether the rights to information, discrimination, equality and reproduction of women have been violated. Likewise, the possible admissibility of an amparo lawsuit against amparo. For the purpose of analysing the case, we have consulted the following sources: the Political Constitution of Peru, Law No. 26482 - General Health Law, the World Health Organization and the North American Federation for the Food and Drug Administration; After a thorough analysis of the group at the casuistic and doctrinal level, we have taken the following position of sharing the plaintiff's point of view, since the Ministry of Health did not have a clear health policy regarding the distribution of the contraceptive method in Peruvian territory.
