This paper presents and analyzes Resolution Nº 002-2024-SUNAFIL/TFL, issued by the Full Chamber of the Labor Inspection Court. This case deals with the affectation of the right to freedom of association and the requirement of reasonableness in the exercise of the Ius Variandi. The legal matter to be examined is the exercise of ius variandi, in the facet of the geographical transfer of the worker, in the context of the state of emergency, and to explain how this relates to the right to freedom of association, when the legal and social circumstances are extraordinary. To analyze the topic, a variety of academic and legal sources were consulted, including articles, books and norms. These sources helped to deepen the conceptual foundations related to the legal issue in question. It is necessary to emphasize that the decision reached by the Full Chamber points to the reasonableness of the employer's decisions, the requirement of proof and the guarantee of the right to freedom of association; in the face of these issues, the criteria adopted reaffirmed the rigidity of the labor relationship, where the employer, even in extraordinary circumstances, must abide by processes that slow down the competitive business dynamics. Therefore, we do not agree with the position of the Plenary Chamber and we postulate in this paper that the criteria adopted are not consistent with an exceptional situation and, on the contrary, encourage the inflexibility of labor ties.
