The purpose of this Professional Sufficiency Work is to analyze the ruling of the Constitutional Court on File No. 01564-2022-PA/TC, which deals with the ruling of the amparo claim; whose substance is the review of the actions taken in the underlying process that encompasses the violation of the children's rights (B.R.B.G.) for the mistreatment caused by Sara Casilda Palomino Patiño, the right to mental integrity being affected and suffering emotional damage due to the violation of his right to be respected by his educators, as a consequence of the public offenses and humiliations that the minor suffered. For this reason, a search was carried out for regulations, scientific articles, books and jurisprudence on the transgressed rights, which will contribute to the identification of the damages caused by the violation of the rights of the minor and, whose consequences are reflected in their behavior, development and integrity. In this way, this work aims to show the existing violation of the fundamental rights of minors in Peru, as well as the importance and relevance of their protection in the national legal system. For this reason, we agree with the decision made by the Constitutional Court and agree that the unfounded ruling in the lawsuit protects the right of the minor B.R.B.G., who deserves to be protected and safeguarded by society and the Peruvian State. Likewise, it is crucial how the Peruvian Constitutional Court has addressed this issue, since its pronouncements not only define the legal framework, but also guide policies and practices related to childhood in the country.
