The present work of professional sufficiency focuses on analyzing the constitutional rights of “reconstituted families” or “blended families”, which include the rights of equality, free development of personality, and recognition as a family institution. In this regard, a legal factual analysis will be made of the ruling issued by the Constitutional Court under the case file N° 01849-2017-PA/TC, which resolves a claim for protection in which it is intended that a third part, in this case the “International Club Arequipa”, does not limit the registration to the members of a reconstituted family, and on the contrary recognizes the paternal filial relationship that is generated among its members and grants the same rights that are given to a nuclear family or also known as a traditional family. For the analysis of the sentence issued by the Constitutional Court, we have resorted to the American Convention on Human Rights, the Political Constitution of Peru, the Civil Code, the Code of Children and Adolescents, jurisprudence and doctrine. In summary, this research seeks to describe the theoretical framework of “reconstituted families”, to demonstrate the lack of effective legal protection for this figure and the need for it to have an adequate legal regulation that recognizes its rights and duties, taking into account that the family is the central axis and nucleus of society.
