This work of professional sufficiency develops the provisions of the State Contracting Tribunal in the Full Chamber Agreement N 002-2022/TCE, in its condition of binding precedent in matters of public procurement, related to the precisions that the Entity must apply for a valid contract termination due to non-compliance of the contractor and subsequent sanctioning procedure. In this sense, the analysis of the members who signed the aforementioned Agreement will be developed, considering the requirements to initiate the sanctioning procedure, the cases of reciprocal contractual termination, what is applicable to the contracts of the Framework Agreements Catalog, the moment in which the ECA must suspend the sanctioning process and when the infraction is actually configured. Likewise, in order to be able to carry out a complete analysis, we will proceed to develop the argument of the members who subscribed singular votes, and we will develop a legal opinion on the matter based on doctrinal, normative and jurisprudential research. Finally, within the framework of the necessary and constant updating of the public procurement regulations, it should be noted that this work will develop an analysis that includes the regulations in force at the time of the issuance of the Agreement under study (Agreement N 002-2022/TCE), in comparison with the regulations in force to date; with the purpose of providing a research work that is useful in the practice.
