Blended families can be defined as those families in which at least one of the spouses has a child from a previous relationship. This concept has been recognized as a type of family, therefore, deserving of constitutional protection, according to Article 4 of the Political Constitution of Peru. However, this type of family faces a series of challenges due to the lack of express regulation in Peruvian law, which in some way causes lack of protection. An example of this is the case of Felix Rafael Neyra Pacheco vs. the Arequipa International Club, which is developed in the Plenary Judgment. Decision 713/2020 of the Constitutional Court. In this sense, the research topic of this paper will focus on the legal problems of blended families with respect to the complexity of parental ties and the legal responsibilities that arise in these family structures. As well as the distinction of treatment in relation to the recognition of rights and obligations of biological children and stepchildren, which weakens the family institution protected by Peruvian law, especially in blended families. Finally, it is important to highlight that the choice of the Felix Neyra case is due to the need to regulate inclusive legal frameworks that recognize and protect the rights and duties of the blended family.
