The Chila Chambilla and Chila Pucará communities filed a Constitutional Appeal against the administrative act of granting the non-metallic mining concessions Chilachambilla I and Chilachambilla II, which were granted without having carried out the prior consultation process. The Constitutional Court declared the appeal for constitutional grievance inadmissible because prior consultation is not literally typified in the Political Constitution of Peru. In addition to this and in analysis of the singular votes of judges Miranda Canales and Ferrero Costa, who argue that the right to prior consultation is not an essential requirement for the granting of the mining concession title, since there is no “certain threat and imminent” directed to the lands, culture and traditions of the aforementioned communities. In this way, an analysis of the factual facts and legal foundations that form part of the ruling by the Constitutional Court in this file will be carried out.Concluding this research work with our position in favor that prior consultation should not be carried out at the time of granting the title of the mining concession.
