The present research work analyzes the sentence issued by the Constitutional Court that falls in file No. 00882-2023-PA/TC, the same one that arises from the amparo action filed by Mr. Ricardo Moran Vargas against the National Registry of Identification and Civil Status (RENIEC) and the Superior Chamber of the Constitutional Court, arguing a constitutional grievance due to the inadequate application of articles 20 and 21 of the Civil Code on the origin or not of the untimely registration of children born in the foreigner, based on resolutions that declare the father's request for registration of his minor children inadmissible; petition that was declared inadmissible in the first and second instances and in the last instance they declared the claim founded. In the present investigation, for a better understanding, a variety of conceptual bases have been consulted such as legal norms, books, scientific articles on the topic in question and other Rulings of the Constitutional Court that have supported the study of the case. Based on what has been investigated, we agree with the majority position of the Constitutional Court, regarding the application of articles 20 and 21 of the Civil Code in the specific situation, since the principle of equality and non-discrimination is applied to the register their minor children, granting them nationality and safeguarding their fundamental rights in response to the best interests of the child and adolescent.
