This Work is based on the analysis of the Judgment based on what was discussed in proceedings 01146-2021-AA/TC, which is a matter of Fundamental Rights. In the first instance, Andrés Zapata Silva, representing his son Pablo Zapata López, filed a claim for protection against the General Management of SALUDPOL, requesting the nullity of Official Letter 063-2016-IN-SALUDPOL-GG, which denied the request acquisition of two hearing aid hearing aids; which was declared founded. In the second instance, the Second Civil Chamber of the Superior Court of Justice of Lima, revoked the appealed resolution and declared it unfounded. Therefore, the plaintiff filed the Constitutional Grievance Appeal before the Constitutional Court. The majority vote declared FOUNDED IN PART and that the summoned entity issue a report on the economic situation and the other criteria established for the acquisition of hearing aids (biomedical material). Likewise, it has a singular vote, and voting grounds expanding criteria on the object of the case. The focus of this work is the deficiency of the investigation and regulatory interpretation carried out by the summoned entity, without regard to the violation of the Fundamental Social Rights of Persons with Disabilities and the viability of the established criteria. This file was chosen to the absence of regulations regarding the due process to be followed by state agents to safeguard the fundamental rights of people with disabilities.
