This paper addresses the discrepancy between Inversiones Generales Libra S.A.C. (hereinafter, the defendant) and Inter Artis Peru (hereinafter, the complainant) and the analysis of Resolution 1185-2021/TPI-INDECOPI, issued by the Specialized Chamber on Intellectual Property of the Court for the Defense of Competition and Intellectual Property (hereinafter, the Chamber). which deals with the infringement of copyright and related rights legislation, with respect to the remuneration of public communication linked to fixed performances in audiovisual works, thus establishing a new binding precedent. In the first chapter, we summarize the Resolution that contains the binding precedent, as well as the development of the positions taken by the complainant and the accused. Likewise, the criterion proposed by the Chamber on the configuration of public communication in hotel establishments will be presented. Secondly, the conceptual bases of this work will be addressed, doctrine of various authors such as: Barreto who offers definitions of Collective Management Societies; Lipszyc and Rubio who deal with public communication; Marcial Rubio, Ibarra and Serrano on remuneration rights; and, Rubio and Landa on freedom of enterprise. Thirdly, we will analyze the criteria developed by the Chamber in chapter 1, taking into consideration the positions presented in chapter 2 and we conclude that the Resolution issued by the Chamber has not addressed issues related to the case. Concluding that a balance must be established between the regulations and interpretations on intellectual property and the freedom of enterprise, in order to protect the copyright of artists, performers and performers, without affecting the development of business activity in the hotel industry.
