Money laundering is a criminological phenomenon that transcends borders with devastating consequences for society. Hence the global need to combat and eradicate this phenomenon; In this context, states and international institutions work and cooperate mutually to prevent, confront, and punish money laundering. Generally, the profits obtained by criminals are introduced into the traditional financial system; however, technological innovation has evolved the financial system, creating new alternatives for payments or investments. Such is the case of virtual assets that are used as a virtual representation of value that is traded or transferred digitally, for example, Bitcoin. These characteristics are used by criminals as a new money laundering mechanism. Therefore, recently countries have regulated the virtual asset sector and others have banned these assets. These loopholes in the global regulatory system allow criminals to take advantage of this situation. In this context, this research work has been prepared to determine the legal viability of a regulatory framework for virtual assets in Peru and propose criteria for their regulation.
