This Private File deals with an Institutional and Legal Arbitration in matters of State Contracting and the Public File deals with a contentious administrative process. In this line of ideas, this work will analyze the failures of each file to determine whether to issue an opinion based on law. The private file addresses an institutional and legal arbitration file where controversies are submitted related to the alleged unjustified non-compliance with contractual execution of item 10 of the Contract, the application of the penalty for alleged unjustified delay, the nullity and effectiveness of resolution of the contract, the alleged modification tacit contract under the regulations of Law No. 30225 and its regulations, conformity and payment. On the other hand, the published file deals with a Contentious Administrative Process followed against the Municipality of Cayma for expanding a construction without a building license. The sanction was imposed on the administrator in the administrative sanctioning procedure, but it was carried out after the entry into force of Legislative Decree No. 1272, which introduced expiration for the first time in the Peruvian administrative legal system. Considering the above, it will be analyzed whether it is appropriate to apply the expiration or not to the administrative sanctioning procedure that originated the case.
