Abstract: El presente trabajo analiza la Sentencia del Tribunal Constitucional recaída el expediente N.º 001-2020-PCC/TC, mediante el cual se examina un presunto menoscabo de competencias a la Municipalidad Metropolitana de Lima en materia de tránsito y transporte terrestre por la aprobación y emisión de la Resolución de Presidencia Ejecutiva N.º 065-2020-ATU/PE que dispuso la creación de una red de ciclovías denominada “Sistema de Transporte Individual Sostenible – SITIS” por parte de la Autoridad de Transporte Urbano, entidad adscrita al Ministerio de Transporte y Comunicaciones.
En primer lugar, se describe de forma cronológica el antecedente del conflicto competencial, el proceso de inconstitucionalidad recaído en el expediente N.º 008-2019-PI/TC, así como los conceptos e interpretaciones del Tribunal Constitucional ahí tratados con la finalidad de determinar sus alcances en relación al presente proceso constitucional de competencias. En segundo lugar, se desarrolla las principales actuaciones en el proceso competencial: los hechos, la demanda competencial, el auto admisorio, los recursos presentados, la contestación de demanda y los votos de los magistrados, haciendo presiones necesarias.
Finalmente, comparto mi postura personal respecto de los principales temas tratados en la Sentencia del Tribunal Constitucional recaída en el expediente N.º 001-2020-PCC/TC, así como las razones por las cuales no comparto los fundamentos del voto en mayoría.
This work analyzes the Ruling of the Constitutional Court of file No. 001-2020-PCC/TC, through which an alleged impairment of the competence of the Metropolitan Municipality of Lima in matters of transportation and land transit is examined due to the approval of the Executive Presidency Resolution No. 065-2020-ATU/PE that provides for the creation of a network of bicycle lanes called Sustainable Individual Transportation System - SITIS by the Urban Transportation Authority, an entity attached to the Ministry of Transportation and Communications . To this end, the background of the jurisdictional conflict is described chronologically, the unconstitutionality process contained in file No. 008-2019-PI/TC, as well as the concepts and interpretations of the Constitutional Court treated there in order to determine the scope. . of the unconstitutionality process in relation to the present constitutional process of powers. Subsequently, the main actions in the jurisdictional process are developed chronologically: the facts, the jurisdictional claim, the order for admission, the appeals presented, the response to the claim and the votes of the magistrates, applying the necessary pressure. Finally, I share my personal position regarding the main issues addressed in the Constitutional Court Judgment issued in file No. 001-2020-PCC/TC, as well as the reasons why I do not share the reasons for the majority vote.
