Abstract: El presente informe versa sobre la demanda de inconstitucionalidad presentada por el Poder Ejecutivo contra la Ley N° 31131, Ley que establece disposiciones para erradicar la discriminación en los regímenes laborales del sector público emitida por el Congreso de la República, que dispone el traslado de los servidores públicos bajo el régimen del Decreto Legislativo N° 1057 (CAS) a los regímenes de los Decretos Legislativos N° 276 y N° 728, acción que motivó la emisión del Pleno de Sentencia N° 979/2021 recaída en el Expediente N° 00013-2021-PI/TC.
A partir de los argumentos de las partes, el Tribunal Constitucional analizó los presuntos vicios de inconstitucionalidad de la Ley en cuestión, respecto de la vulneración de los artículos 40, 43, 78, 79 y 118, incisos 3 y 17, de la Constitución Política del Perú. El colegiado determinó que no es viable el traslado de los CAS a los regímenes de la carrera administrativa y actividad privada, enfatizando que la Ley N° 31131 no resolvería el problema de diferencia entre los regímenes laborales que forman parte del Estado, sino que lo acentuaría.
En ese sentido, el objetivo del presente informe es realizar un alcance de los puntos advertidos por el Tribunal Constitucional, los votos en singular emitidos por los Magistrados, considerando como solución el traslado a un régimen único, que respete el principio de meritocracia y brinde estabilidad a los servidores públicos.
This report deals with the unconstitutionality suit filed by the Executive Branch against Law No. 31131, Law that establishes provisions to eradicate discrimination in public sector labour regimes issued by the Congress of the Republic, which provides for the transfer of public workers under the regime of Legislative Decree No. 1057 (CAS) to the regimes of Legislative Decrees Nos. 276 and No. 728, action that lead to the issuance by the Plenary Judgment No. 979/2021, in Case No. 00013-2021-PI/TC. According to the arguments of the parties, the Constitutional Court analysed the alleged unconstitutionality defects of the law in question, related to the violation of articles 40, 43, 78, 79 y 118, subsections 3 y 17, of the Political Constitution of Peru. The Constitutional Court determined that it is not viable to the transfer the CAS to the administrative career and private activity regimes, emphasizing that Law No. 31131 would not solve the problem of difference between the labour regimes that form part of the State, but rather would accentuate it. In this sense, the purpose of this report is to make a scope of the points raised by the Constitutional Court, the singular voted cast by the Magistrates, considering as a solution the transfer to a single regime, which respects the principle of meritocracy and provides stability to the public workers.
