Divorce based on de facto separation is a remedy divorce by which the marriage bond is dissolved as a consequence of the de facto separation of the spouses through no fault of their own. The Third Plenary Court of Civil Cassation has ruled that as a result of the divorce that a sum be awarded in favor of the injured spouse for the purpose of family solidarity, and to correct the imbalance resulting from the separation, quantifying the degree of damage based on the criteria established by the fourth binding precedent of the Third Plenary Court of Civil Cassation (hereinafter, the “Precedent“). This paper analyzes Cassation No. 2341-2020-Callao, in which the appealed judgment was annulled, considering that the courts of merit quantified the amount of compensation without analyzing the degree of damage based on precedent. This omission would cause an imbalance resulting from the separation which cannot be corrected, contrary to the main purpose of this compensation. For the analysis of the research topic, relevant sources on the subject have been used, consulting authors such as Plácido, who was also cited in the Third Civil Cassation Plenary, Lara, Balcazar, Mejias and Moreno, who have articles published in indexed bases of current relevance. In conclusion, the awarded sum must coincide to a lesser or greater degree of damage to the injured spouse, quantifying it based on the precedent. Thus, if there is greater damage according to the precedent, the amount of compensation will be higher, otherwise, it will decrease, which will serve to correct the imbalance of the injured spouse. This honors the main purpose (monetary compensation) in the divorce on the grounds of de facto separation.
