The present case to opt for the professional title of lawyer deals with the appeal filed by Nancy Hilda Puemape Basurco against the ruling in the case of divorce due to de facto separation. During the litigation, important concepts for civil law are debated, among which we have the following: dishonorable conduct, the figure of the most harmed spouse, moral damage and economic distress as a consequence of divorce. Based on what was developed in the ruling, we have considered it of great importance to analyze the legal matter referring to the cause of de facto separation as one of the factors that contributes to the declaration of separation of bodies or divorce. It is worth mentioning that the cause we mentioned is relatively new since it was incorporated into the Peruvian legal system in 2001 through Law No. 27945. This work will begin with the description of the previously mentioned case in order to later carry out a exhaustive analysis of the cause of de facto separation and the way in which it has been applied in our country. For this, the main sources we have resorted to are the Political Constitution of Peru, the Peruvian Civil Code, jurisprudence, among others.
