This work analyzes the amparo action and the constitutional grievance appeal against the administrative sanctioning process (PAS), with the exoneration of the exhaustion of the prior administrative route provided for in the constitutional procedural code. In this sense, in the present case, the Metropolitan Municipality of Lima ( MML) initiates an administrative sanctioning process against “ Trastiendas Integradas S.A.C '' because it does not have the required Road Impact Study ( EIV). In this way, the MML, through an administrative resolution, files a fine and orders the stoppage of the work. Thus, the plaintiff files an amparo action against the MML requesting the annulment of the PAS where the fine and stoppage of the work is established. In turn, the fifth Constitutional Court declared the claim founded because the shopping center is not located in front of Pedro Miotta Avenue, but in front of Los Lirios Avenue, which is a local Avenue, consequently, the PAS initiated by the MML was declared void. At the time. The second civil chamber declared the claim unfounded, considering that the actions of the MML are in accordance with the legal system, since according to the text of the notarial certification, it appears that the front of that property is the Atocongo highway (metropolitan route) so the EIV was necessary. Finally, a constitutional appeal is filed against the resolution of the second civil chamber. Thus, the topic of investigation is whether the amparo action is viable or if there is an equally satisfactory way to protect the threatened rights. To do this, various types of sources were consulted such as the UPC library, UPC SCOPUS, SCIELO, EBSCOHOST. Finally, the authors reached the conclusion that the amparo action is the ideal remedy for the present case, due to the risk, threat and violation of constitutionally protected rights that would be affected in the administrative litigation process.
